Please read this Maicat privacy policy (“Privacy Policy”) carefully, so you can fully understand how Macroact Inc. (“Macroact” “we”, “our” or “us”) uses, collects and stores information pertaining to persons using or accessing AI home robot Maicat™ (“Maicat”, “Maicat Robot ”), the Maicat App (“App”) (“User”, “you”) and what options and rights are available to you in such respect, such as when you interact with Maicat , the Maicat app or when you contact us through customer support.
This Privacy Policy forms part of the Maicat Terms and Conditions, available at [Link to Maicat Terms and Condition] and from within the Maicat App (“Terms”), which you have accepted prior to using Maicat and the app for the first time.

YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOU ARE PROVIDING US WITH SUCH INFORMATION OF YOUR OWN FREE WILL, FOR THE PURPOSES DESCRIBED BELOW, AND THAT WE MAY USE, PROCESS AND RETAIN SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND SUBJECT TO ANY APPLICABLE LAWS AND REGULATIONS.
Through Your Interactions with our Services
Whenever you visit or interact with the Services, Macroact and its third-party service providers automatically collect certain information regarding your use of the Services and your device ("Usage Information"). Usage Information may include, in part, browser type, operating system, and the areas of the Services you access, such as the App (including the time at which an area is accessed, the duration of the access, and the way you navigate between areas of the Services). We also collect your IP address and/or another unique identifier ("Device Identifier") that identifies the Maicat Product, computer, mobile device, or other device you use to access the Services. Some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the device used to access the Services. Macroact generally treats this information as non-personal information to the extent permitted by law.
Through the Maicat Robot and App
General System and Input Information (App). We may collect the serial number of your Maicat device to create your Maicat ID.
USER UNDERSTANDS AND CONSENTS THAT MAICAT UTILIZES CAMERAS AND MICROPHONES TO ENABLE MAICAT TO INTERACT WITH USER AND NAVIGATE ITS SURROUNDINGS TO PROVIDE THE USER WITH THE SERVICES. AUDIO VISUAL DATA ARE CONSIDERED USERS’ PERSONAL INFORMATION AND ARE TREATED AS SUCH IN ACCORDANCE WITH THIS PRIVACY POLICY.
Cameras and microphones are utilized by Maicat to enable interaction with and by Maicat and the User. The Cameras and microphones monitor their immediate surroundings and ambient sound to detect whether someone is nearby, be prompted to receive and act upon User’s vocal instructions or other sounds, and consider whether to initiate interaction with the User. Maicat captures visual and audio data solely for the purpose of local processing and operation.
Maicat utilizes machine learning algorithms for on-board processing to enhance its functionality. All machine learning processes take place exclusively on the internal computer of the Maicat Robot.
The Maicat Product owner may choose to enable the Maicat Product's automatic photography function. This feature is not required to use the Maicat Product and is turned off by default. In the event that an owner elects to enable this function, the Maicat Product will automatically capture photographs using its internal camera. After taking the photographs, the Maicat Product will store these temporarily on its internal computer. The user can choose if he or she wants to transmit those photos to the owner's Maicat app. When the internal storage is full the oldest photos will be deleted by the Maicat Product automatically.
In order to better recognize family and other familiar people the Maicat Product conducts a facial analysis of those it observes through its camera.
To allow the machine learning model to utilize this data it is stored temporarily on the robot’s internal computer.
In addition to the categories of information obtained by Macroact discussed above, our Services may generate data automatically when you use certain features (e.g. Maicat’s smart recognition technology that allows the device to understand and interact with its environment) (“Smart-Recognition Data”), or may utilize data that you generate independently (e.g. registering biometric data such as your facial profile to register with your robot device). All of this data remains on the device and is not transmitted to Macroact, nor does Macroact obtain or access this data. Macroact does not share this data with third parties. Biometric Data will remain on your device until you reset your device to its factory setting. Because Macroact does not have access to this data, Macroact cannot delete it.
Macroact does not collect or store facial recognition data or other biometric information collected through the Maicat device.
The above described facial recognition data may constitute "biometric information" or a “biometric identifier” under the laws of some jurisdictions and is treated as Personal Information for purposes of this Privacy Policy. By registering and using a Maicat Product, each Maicat Product owner consents to this collection of facial recognition data by robot Maicat and use of that facial recognition data as described in this section for so long as (s)he owns a Maicat Product. Each Maicat Product owner further agrees that (s)he will obtain a similar consent from any person whom (s)he allows to be in proximity to or to interact with his or her Macroact Product.
Most of the data the Maicat device is collecting is temporarily stored locally on its internal computer or deleted immediately by the Maicat robot, and is not shared with Macroact or stored on any external servers.
In some instances it is possible for you, as the user, to securely transmit certain data, like photographs Maicat has taken, and if this feature is enabled, to the Maicat App.
Macroact has no access to any of your personal data and other data generated while using and interacting with the Maicat robot.
What types of data and information we may collect in connection with your use of the Services?
We may collect two types of data and information when a user uses or accesses Maicat or the Services:
● Personal Information, which is information that identifies an individual or may with reasonable effort identify an individual, either alone or in combination with other information (such as an identification number), or may be of private or sensitive nature, all unless anonymized. Such categories of Personal Information may include:
○ Contact details of Users or User connected parties (e.g. family members) and billing information;
○ The contents of your interaction with the Macroact Team, which may include text/video/audio recording and transcripts of such communications, either via its services or in any other communication method;
○ Feedback, questions and complaints information;
○ Usage logs information;
○ Billing Information;
○ Location Data;
○ User login data;
○ Information mandated by Law: Information we are required or authorized by applicable national laws to require Users to provide us in order to authenticate or identify them or to verify the information we have collected or otherwise provide them with our Services.
● Non-personal Information, which is non-identifying and non-identifiable information, without particular reference to the identity of the User from or about whom such information was collected.
How do we collect personal information from our Users?
We collect Personal Information from you that you voluntarily and actively provide us when you use or interact with our Services
By this, we refer to Personal Information that you input to the Services or voluntarily make available in the course of your use of the Services. Such information may include:
Through certain Services, we may collect personal information about your online activities on websites and connected devices over time and across third-party websites, devices, apps, and other online features and services. We may use third-party analytics services on the Services, such as Google Analytics. The information we obtain may be disclosed to or collected directly by these providers and other relevant third parties who use the information, for example, to evaluate use of the Services or help administer the Services. How We Use the Information We Obtain
We may use the personal information we obtain to:
• provide and enhance our Services, identifying and authenticating you so you may use and interact with our Services (such as your device) and third-party services, and improving and customizing your experience within the Services;
• support our marketing activities and sales initiatives, and provide you with product and service recommendations;
• communicate with you;
• provide customer support;
• operate, evaluate, and improve our business, including developing new products and services, managing our communications, analyzing our Services and customer base, conducting market research, aggregating and anonymizing data, performing data analytics, and undertaking accounting, auditing, and other internal functions;
• protect against, identify, and prevent fraud and other criminal activity, claims and other liabilities; and
• comply with and enforce applicable legal requirements, relevant industry standards, and our policies, including this Privacy Policy and the applicable Terms of Use for a Service.
Security of your personal data
We take great care in implementing and maintaining the security of the Services and of your Personal Information. We employ industry standard procedures and policies to ensure the safety of your information, reduce the risks stemming from loss of information and prevent unauthorized use of any such information. However, we do not and cannot guarantee that unauthorized access will never occur and reiterate that no measure can provide absolute information security. Please be careful to use secure WiFi connections when accessing the Services and never share your password or Maicat ID. You understand that any message or information you send to a Service may be read or intercepted by others. Macroact does not ensure or warrant the security of any information you transmit to us, and you use the Services and provide us with your information at your own risk.
How long do we keep your information?
We will retain your personal information for as long as you use our Services and for a reasonable time thereafter. Macroact will retain the information collected under this Privacy Policy for as long as you use the Services and for a reasonable time thereafter. Macroact will take steps to remove or delete the information when it is no longer needed. Please note that we may need to keep your information to comply with applicable legal, regulatory, or other obligations, or the information is required for business reasons (such as to resolve disputes, provide service and enforce agreements), and we may be required to retain certain information by law.
Information collected by Maicat can be deleted by you any time by resetting the device to its factory settings. You can delete the App from your mobile device anytime, which will result in the immediate deletion of any data and information shared with the App.
Your rights
If the law applicable to you grants you such rights, you may ask to access, correct, or delete your Personal Information that is stored in our systems. You may also ask for our confirmation as to whether or not we process your Personal Information.
Subject to the limitations in law, you may request that we update, correct, or delete inaccurate or outdated information. You may also request that we suspend the use of any Personal Information whose accuracy you contest while we verify the status of that data.
Subject to the limitations in law, you may also be entitled to obtain the Personal Information you directly provided us (excluding data we obtained from other sources) in a structured, commonly used, and machine-readable format and may have the right to transmit such data to another party.

When handling these requests, we may ask for additional information to confirm your identity and your request.
Please note, upon request to delete your Personal Information, we may retain such data in whole or in part to comply with any applicable rule or regulation and/or to respond to or defend against legal proceedings brought against us or our affiliates.
Additional Information for California Residents
If you are a California resident using the Services, the California Consumer Privacy Act (“CCPA”) may provide you the right to request access to and deletion of your Personal Information.
In order to exercise the right to request access to and deletion of your Personal Information, please see the information on section 12, above. We do not discriminate based on the exercise of any privacy rights that you might have under this Section.
Macroact does not sell user Personal Information to third parties for the intents and purposes of the CCPA.
All requests must be labeled “California Removal Request” on the email subject line. All requests must provide a description of the content you want removed and information reasonably sufficient to permit us to locate that content. We do not accept California Removal Requests via postal mail, telephone, or facsimile.
Please note, upon request to delete your Personal Information, we may retain such data in whole or in part to comply with any applicable rule or regulation and/or to respond to or defend against legal proceedings brought against us or our affiliates.

If you have any questions or concerns about our collection, use or disclosure of Personal Information, or if you believe that we have not complied with this Privacy Policy or applicable data protection laws, please contact us at support@macroact.com.
We will investigate the complaint and determine whether a breach has occurred and what action, if any, to take. We take every privacy complaint seriously and will make all reasonable efforts to resolve your complaint promptly and in accordance with applicable law.
You can file a complaint with your local supervisory authority for data protection at any time, however we recommend that you contact us first so we can try to resolve it.
Updates To This Privacy Policy
We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our personal information practices with respect to the Services. We will indicate at the top of the policy when it was most recently updated.
